Walram, lord of Valkenburg and Monschau, announces that the director and convent of St. Gerlach in Houthem, with the consent of the dean and chapter of St. Servaas church in Maastricht, in free possession of the chapter, have built a wall around their monastery on a piece of land of 80m in length and 5.75m in width on the side of Berg against a hereditary annual interest of two penning Liege. Walram acknowledges that he has no rights to this land.

Dirk van Heeswijk, knight, undertakes - in the name of the convent of the abbey of Thorn - to obtain at his expense the charter of the bishop of Utrecht, in which the appointment and presentation of the priest of the church of Avezaath nominated by him was regulated by the abbess of Thorn, as well as his income. The collation belonged to the abbess of Thorn. After obtaining this charter, Dirk will acquire from the abbess and convent of Thorn the tithes in lease and all other goods that the abbey at Avezaath has, except for the goods that St. Paul's Abbey at Utrecht has from the abbot and convent of Thorn. Nor will knight Otto van Zoelen make any feudal tribute to Dirk van Heeswijk for the goods he now temporarily holds from the abbess and convent of Thorn. As long as the matter is not completed, Dirk shall not appropriate the goods belonging to the church of Avezaath without the consent of the abbess and convent or of the parish priest of Avezaath. And as soon as the church of Avezaath is vacant, Dirk will present priest Gerard of Avezaath for installation. Should Dirk not receive the charter from the bishop of Utrecht within six months, every agreement and promise between him and the abbess and convent of Thorn will expire.

2. Jan, son of the late knight Wijnand, and his children have renounced one-fourth part in that house

3. Dirk de Lata Platea has renounced one-fourth share in that house, as well as one-half of one-fourth share due to him by right of inheritance

4. Oda, mother of Dirk, with the consent of her children has given half of one-fourth part in that house hereditarily to the administrator and convent of St. Gerlach against an annual production charge of fifteen shillings Liege. Administrator and convent will pay the land tax to the bishop of Liege, and Oda will not give or receive any fee.

The aldermen of Maastricht certify that Oger, lord of Borgharen, knight, guardian of Maastricht, with the consent of his wife and their children, has donated a fourth part of a stone house, situated on the Graanmarkt at Maastricht, to the provost and convent of St. Gerlach (at Houthem), that Jan, son of the late Wijnand, knight, and his children have renounced a fourth part in that house, that Dirk de Lata Platea has renounced a fourth part in that house as well as half of a fourth part that is hereditarily due to him and that Oda, mother of Dirk, with the consent of her children, has hereditarily given half of a fourth part in that house to the provost and convent of St. Gerlach against an annual property tax payment. Hendrik, Friar Minor, Bishop of Chiemsee and Vicar of Hendrik III, Bishop of Liege, declares that he has consecrated five altars in the abbey of Thorn. For the thirty days following the day of the consecration of these altars he grants to all who repent an indulgence of one hundred days and of a forty-day fast. An identical indulgence is henceforth bestowed on each annual feast of this altar dedication, on feast days in honour of Mary for all consecrated altars in the monastery and on the days of saints to whom an altar is dedicated and to all the faithful who wish to be of assistance to the monastery.

Abbot Hendrik and the convent of St. Paul's Abbey in Utrecht promise for five years to convert all revenues from their tithes and goods at Zandwijk into money and to give this money to the abbess and convent of Thorn as compensation for the overdue rent to Dirk van Heeswijk from the goods at Avezaath and Hemert. Should a conflict arise between the abbesses about this, they will entrust a decision to two named arbitrators. Agreements will also be made about a possible third arbitrator. For making and executing the conditions, the abbot and convent of St. Paul's Abbey also appoint sureties. At the request of the abbess and convent of Thorn or their manager, these sureties will come to Rhenen or Tiel and remain there until the matter is settled to the satisfaction of the abbess and convent of Thorn.

Date

The present charter is undated. Terminus ante quem is the validation dated 28 Aug. 1270, of Hendrik, provost of St. Apostle's Church in Cologne, and Marcoald, archdeacon of Liege and papal chaplain. Otto of Everstein was with certainty provost of Aachen and provost of the chapter of St. Servaas in Maastricht from 1218. His function as provost in Aachen was interrupted only in the years c. 1239 to 1242 because of his candidacy for the bishop's seat in Liege (Hackeng, The medieval landholding, 86). Respectively after 1261 and 1265 he is no longer mentioned in the sources as provost of the chapter of St. Servaas and of Aachen (see Doppler, "List of the provosts," 187, and Ubachs and Evers, Historical Encyclopedia). The anniversary of his death is 27 October (Quix, Necrologium Aquensis, 59). Teichmann, "Aachen," 91-93, suggests 1266 as a possible year of death, but Meuthen, "Die Aachener Pröpste," 83, still identifies Otto in a charter dated 10 September 1270. Since from 1270 a new provost of the chapter of St. Servaas is known as Otto's successor, namely Otto of Gulik, and in 1271 a new provost is appointed in the cathedral chapter in Xanten where Otto had been provost since 1266, it does not seem implausible that he died on 27 October 1270.

Doppler's dating of this charter in the year 1269 is based on the mention of William, Arnoud and Iwein as the guardian, bailiff and mayor of Aachen, respectively, who, according to Quix, Geschichte der Stadt Aachen, 99, appear in charters jointly only in 1269 (in 1265 William appears as guardian together with mayor Ricolf).

The dispositio of the present charter refers to the common law of succession in force in the banks, which the chapter has held for more than sixty years, 'in curiis vestris pro iure consueto et obtento iam sexaginta annis et amplius'. The clause 'iam sexaginta annis et amplius' may refer both to customary law in force in the banks and to a right recorded in a charter. Assuming a dating in 1269 based on the mentioned Aachen dignitaries, the present charter could then refer to a charter dating before 1209.

Willem, administrator, and the convent of Sint-Gerlach in Houthem declare that they owe to Hendrik van Retersbeek and Clementia, his wife, citizens of Maastricht, an annual annuity of 630kg and eighteen barrels of rye for the donation of 144,000m2 of land in Beek and lands in Haasdal. 120,000m2 of the 144,000m2 depend on the lord of Valkenburg and 24,000m2 on Godfried van Audesteyde, and the lands in Haasdal depend on the governor of Meerssen. The administrator and the convent also draw up clauses in case of the death of Hendrik or of Clementia. Walram, lord of Valkenburg, approves this agreement.

Jan, provost, Gillis, deacon, the archdeacon and the cathedral chapter of Liege declare that an inquiry has taken place in the abbey of Thorn concerning the goods at Avezaath and Hemert and the lease sum paid by St. Paul's abbey from them. They have read this report, which has shown that the benefit of both abbeys has been sufficiently established in the written agreement and that the lease sum has been doubled after many disputes. At the request of the abbess and convent of Thorn, the provost, dean, archdeacon and the cathedral chapter of Liege approve this revised lease.

After this the convent has sold this land to Jan Suevus, citizen of Maastricht.

He asks the convent to take in one of the daughters of Godfried van Spaubeek, a knight, and donates to her a bed. For the costs of her entry he donates 350kg of rye and 70kg of wheat from his property in Hegge, and as long as she lives he donates 1 mark sterling and 70kg of rye annually. Furthermore, he bequeaths a number of goods to his niece, daughter, maid and servant and appoints a number of persons as executors of his will.

Arnoud, priest and vicar of the church of Oeteren, intends to go to sea as a crusader and therefore donates by testament half of his inheritance in the parish of Oeteren to the abbey of Thorn and the other half to Our Lady's Abbey of Oeteren, with the exception of an annual property tax of four capons which he previously donated to the abbess of Thorn. Arnoud transfers to his son Jan the usufruct of these goods and his other movable property under a number of conditions. For the execution of his will and the supervision of the conditions he appoints a number of persons. They will give Jan a monetary allowance, make him go to school and grant him the necessities as long as he behaves decently, because Arnoud desires Jan to become a clarical order member. If Jan does not comply with the provisions and will of the executors of the will, the abbesses of Thorn and Oeteren will give him ten marks Liege. At his death the bequeathed goods are to benefit pious causes. The executors of the will shall do or determine nothing without the abbess of Thorn. With this will Arnoud revokes the bequest or will he previously made before the aldermen of Oeteren.

With the consent of the abbess, canons and nuns of Thorn as well as Gozewijn, parish priest of Baarle, he adds a number of new provisions concerning the revenues of the church of Baarle. All tithes that the parish priests normally received in the churches of Baarle and Mierlo will now be ceded to increase the prebends of the canons and convent sisters of Thorn. Michael, canon of the Chapter of Our Lady at Maastricht, and Godfried Bec of Übach decide in a long-standing dispute between the abbess and convent of Thorn and Gerard Bec, brother of Godfried, about the farm, fields and buildings of the abbey at Übach. After questioning both parties and others, the mediators decide as follows: Gerard returns the charter about the reclaimed land of the farmstead at Übach to the abbess and convent. He and the family involved renounce (alleged) rights to the farmstead at Übach and will vacate the farmstead by order of the abbess and convent. He also renounces all rights to the Kedelmar farmstead at Übach and may decide himself whether to remove the granary there or leave it in place for a fee. The abbess and convent compensate Gerard both in money and in grain. The abbess has Gerard's position as a cook investigated and judged. Should he not rightly possess that function, he will receive compensation in grain and money from the abbess. Whether Gerard's mother Helka has any right to any land is further investigated.

The aldermen of Maastricht announce that Hendrik van Retersbeek, of sound body and mind, has transferred his movable property and claims to Dirk, commander of the Teutonic Order, for the benefit of the house and the friars of the house of St. Mary at Aldenbiesen. This transfer has been made on the condition that the administrator and the convent of the monastery of St. Gerlach in Houthem are exempted from all claims, disputes, obligations and other matters with regard to these goods, except for an annuity of 420kg of rye Maastricht measurement that grows on the other side of the river Maas. The administrator and the convent of St. Gerlach must pay this annuity to the commander and friars at Maastricht as long as Hendrik shall live, and this interest will return to them free and whole after his death.

The aldermen of Maastricht certify that Hendrik van Retersbeek, healthy in body and mind, has transferred his movable property and claims to Dirk, commander of the Teutonic Order, for the benefit of the house and the friars of the house of St. Mary at Aldenbiesen, on the condition that the provost and convent of the convent St. Gerlach (at Houthem) are free from all claims, disputes, obligations and other matters with regard to these goods, except for an annuity of rye that grows on the other side of the Maas. Consequently, this scriptor can be located in the circles of the aldermen's court of Maastricht.

Origins and text edition

The present charter has been handed down through two transcripts in the same cartulary, which differ in one essential point, namely the maximum number of convent sisters. Copy B mentions fifteen, copy C thirty. Although these transcripts are in the same cartulary No. 1, they were considered by the copyist to be two different charters with separate headings in the index and with a unique reference number. Both cartulary transcripts refer to an original charter. Apart from the different number of monastic sisters, the variant research indicates the existence of two different versions. In all probability, these go back to a double issue, one copy for the lord of Valkenburg and Monschau and one for the monastery of St. Gerlach. The number of thirty convent sisters in copy C seems most probable to us, because Dirk IV, lord of Valkenburg and Monschau, in a charter dated. 15 February 1345, declares that hewill respect the prohibition toadmit more than thirty nuns into the convent of St. Gerlach: et ea de causa receperunt et habent inhibitionem a suis superioribus sive praelatis ne aliquando de caetero recipiant domicellam in suum conventum donec ad tricesimum numerum redigantur (see Habets, 'Houthem-Sint-Gerlach', 216-217, no. 10). Consequently, for the text edition, copy C was preferred as the basic text, with an indication of the variants of B in the notes.

The family had the goods and rights on condition of fief, property taxs or otherwise from the abbess and convent of Thorn, and now Mabilia and her children sell everything again to the owners in Thorn. With this agreement, all grudges and disputes, justified or not, expire and is replaced by eternal peace. As an additional security, Mabilia and the children appoint five persons as sureties, should the abbess and convent encounter any obstacle. Until the settlement these sureties must reside in Stokkem.

Origin and coherence

Willem van Born, priest of Geertruidenberg, issued two charters renouncing his claims regarding a dispute with the abbey of Thorn. The present charter concerns his relationship with the chapter of St. Lambert at Liege, the second with the bishop of Liege and the archdeacon dated 1283 (shortly before 16 March) (see Thorn Collection, no. 49). Both charters show strong dictation affinity but were not written by the same hand. The present charter is, however, the pre-correspondence of Collection Thorn, no. 49.

Although this charter has not been copied in the cartulary of the abbey of Thorn (Maastricht, HCL, access no. 01.187B, archive Fiefdom of Thorn, inv. no. 1628), this manuscript does contain a reference to this document under the copy of the charter concerning the relations with the bishop and the archdeacon (Collection Thorn, no. 49): Similis adhuc littera habetur quo isteWilhelmus, investitus de Monte SancteGertrudis, obligavit se capitulo Leodiensi contra predictam compositionem non venire debere.

Willem, priest of Geertruidenberg, after his excommunication and imprisonment as a result of not complying with a verdict of Jan (of Enghien), bishop of Liege, renounces his claims concerning the dispute with the abbess and community of the abbey of Thorn, including the promised obligation towards him by the knights Hendrik, lord of Pietersheim, and Michael, lord of Rothem. He also promises, as additional security, to vacate his church should he or his associates act against it and to pay a fine to the abbess of Thorn and the bishop of Liege, for which he appoints sureties. Jan (of Flanders), bishop of Liege, approves these provisions, as does Gerard of Nassau, archdeacon of Liege, who also declares to install a new priest at Geertruidenberg on the recommendation of the abbess of Thorn, if Willem should fail to comply with the conditions set.

The use of Easter style in the diocese of Liege has been assumed, see Camps, ONB I, XXI, and Dillo and Van Synghel, ONB II, XVII. The present charter lacks the date in the datatio. This charter was most likely edited shortly before the charter of Jan (of Flanders), bishop of Liege, dated 17 March 1283 (see Thorn Collection, no. 50), in which he refers to William's two charters (see Thorn Collection, nos. 48 and 49).

Origin and coherence

This charter was not written by the same hand as the agreement issued by Willem, priest of Geertruidenberg, on 6 January 1283 (see Thorn Collection, no. 48). However, the present charter was substantiated by a scriptor from the abbey of Thorn, who was active in the period 1282-1283. For locating this scriptor, see Thorn Collection, no. 45.

Alexander and Hendrik, respectively deacon and cantor of the chapter of Our Lady at Maastricht, are appointed arbitrators in a dispute between the abbess and convent of the abbey of Thorn on the one hand and Jan, parish priest of Thorn, on the other, concerning the noval tithes in the parish of Thorn, the canonry, Jan's prebend and certain parochial rights. After reading the charter with the compromise thereon and after competent deliberation they pronounce judgment and both parties voluntarily submit to it.

Abbess Guda of Rennenberg and the convent of the abbey of Thorn establish a beguinage at Thorn for twelve beguines and designate for that purpose abbey property, rents and revenues at Eisden, originating from the property of Mabilia, widow of Hendrik, guardian of Eisden and her children. Guda and the convent pledge these goods to the beguine Ida, widow of Hendrik Pauwens, and they also make provisions regarding their use. Finally, they lay down the obligations of the beguines.
