Both the original and the simultaneous copy were minted by a scriptor from Thorn Abbey, who worked from 1262 to 1273. For locating this scriptor, see Thorn Collection, no. 17.

On 1 December 1270 the abbess and convent of Thorn issued a charter in which they enjoined the guarantors stipulated in the present charter, namely Steven, deacon of St. Peter's church in Utrecht, Hubert, treasurer of St. Peter's church in Utrecht, Tielman van Keulen, Gijsbert van Amstel and master Hendrik, canons of the Chapter of Our Lady in Utrecht, enjoined to go into levy within Rhenen or Tiel because St. Paul's Abbey had not made the promised payment to Thorn Abbey. According to Ketner, OSU IV, 58, no. 1790, this charter was kept in the archives of the abbey of Thorn under inv. no. 45 and was transfigured to copy B of the present charter. Currently this document is no longer available. For the edition of the charter dated 1 December 1270, see Ketner, OSU IV, 58-59, no. 1790.

The abbot and convent of Kloosterrade sell all their goods at Houthem in the lands and jurisdiction of the lord of Valkenburg to provost and convent of St. Gerlach monastery (in Houthem) for a sum of money, with which the abbey discharges the outpost at Gerse.

Dating, origin and coherence

The use of Easter style by St. Michael's Abbey in Siegburg has been assumed in accordance with the annual style used in the archdiocese of Cologne during this period, see Polak and Dijkhof, Kloosterrade Book of Charters, XVI. Assuming Easter style, the terminus post quem is 12 April 1286. The terminus ante quem can be derived from a charter of Jan, provost in Millen, dated 28 April 1286, which mentions the present charter: per cartulam que litere domini abbatis de Sigebergh est innexa et sigillo nostro sigillata protamur, see infra no. 30. This passage also shows that the charter, issued by Jan, provost in Millen, is a transfix. Both charters have been copied in the 18th-century cartulary under the same heading.

Deacon Amelis and deacon Steven of St. Peter's Church in Utrecht validate a charter of abbess Hildegonde and the chapter of Thorn dated 27 April 1237, concerning the tithing of Hemert and the revenues at Avezaath.

William, guardian, Arnoud, bailiff, Ywein, mayor, and aldermen of Aachen notify Otto (of Everstein), provost of the imperial churches of Aachen and Maastricht, that no one but the Roman catholic king or emperor can change the law in force for more than sixty years in the benches of the Chapter of St. Servaas in Maastricht.

Date

The present charter is undated. Terminus ante quem is the validation dated 28 Aug. 1270, of Hendrik, provost of St. Apostle's Church in Cologne, and Marcoald, archdeacon of Liege and papal chaplain. Otto of Everstein was with certainty provost of Aachen and provost of the chapter of St. Servaas in Maastricht from 1218. His function as provost in Aachen was interrupted only in the years c. 1239 to 1242 because of his candidacy for the bishop's seat in Liege (Hackeng, The medieval landholding, 86). Respectively after 1261 and 1265 he is no longer mentioned in the sources as provost of the chapter of St. Servaas and of Aachen (see Doppler, "List of the provosts," 187, and Ubachs and Evers, Historical Encyclopedia). The anniversary of his death is 27 October (Quix, Necrologium Aquensis, 59). Teichmann, "Aachen," 91-93, suggests 1266 as a possible year of death, but Meuthen, "Die Aachener Pröpste," 83, still identifies Otto in a charter dated 10 September 1270. Since from 1270 a new provost of the chapter of St. Servaas is known as Otto's successor, namely Otto of Gulik, and in 1271 a new provost is appointed in the cathedral chapter in Xanten where Otto had been provost since 1266, it does not seem implausible that he died on 27 October 1270.

Doppler's dating of this charter in the year 1269 is based on the mention of William, Arnoud and Iwein as the guardian, bailiff and mayor of Aachen, respectively, who, according to Quix, Geschichte der Stadt Aachen, 99, appear in charters jointly only in 1269 (in 1265 William appears as guardian together with mayor Ricolf).

The dispositio of the present charter refers to the common law of succession in force in the banks, which the chapter has held for more than sixty years, 'in curiis vestris pro iure consueto et obtento iam sexaginta annis et amplius'. The clause 'iam sexaginta annis et amplius' may refer both to customary law in force in the banks and to a right recorded in a charter. Assuming a dating in 1269 based on the mentioned Aachen dignitaries, the present charter could then refer to a charter dating before 1209.

The aldermen of Maastricht certify that Hendrik van Retersbeek, healthy in body and mind, has transferred his movable property and claims to Dirk, commander of the Teutonic Order, for the benefit of the house and the friars of the house of St. Mary in Aldenbiesen, on the condition that the provost and convent of the convent St. Gerlach (in Houthem) are free from all claims, disputes, obligations and other matters with regard to these goods, except for an annuity of rye that grows on the other side of the Maas. The provost and convent of St. Gerlach must pay this life annuity in Maastricht to the commander and brothers in Maastricht as long as Hendrik lives, and this interest will return to them freely and completely after his death.

The present charter for the abbey of Val-Dieu in Aubel was written by a scriptor who substantiated aldermen's charters of Maastricht for the abbey of Val-Dieu dated 24 June 1276 (see Collection of St. Servaas Chapter, nos. 43 and 44), for a priest in Maastricht dated 9 July 1278 (see Collection of St. Servaas Chapter, no. 45), for the St. Servaas Chapter in Maastricht dated 6 October 1285 (see Collection of St. Servaas Chapter, no. 56), for a private individual dated 25 June 1287 (see Collection of St. Servaas Chapter, no. 58), for a beguine in Maastricht dated 24 April 1288 (see Collection of St. Servaas Chapter, no. 59), as well as a charter from judge and aldermen of the court of Lenculen for a private individual dated 17 March 1291 (see Collection of St. Servaas Chapter, no. 69). Consequently, this scriptor can be located in the circles of the aldermen's court of Maastricht.

Origins and text edition

The present charter has been handed down through two transcripts in the same cartulary, which differ in one essential point, namely the maximum number of convent sisters. Copy B mentions fifteen, copy C thirty. Although these transcripts are in the same cartulary No. 1, they were considered by the copyist to be two different charters with separate headings in the index and with a unique reference number. Both cartulary transcripts refer to an original charter. Apart from the different number of monastic sisters, the variant research indicates the existence of two different versions. In all probability, these go back to a double issue, one copy for the lord of Valkenburg and Monschau and one for the monastery of St. Gerlach. The number of thirty convent sisters in copy C seems most probable to us, because Dirk IV, lord of Valkenburg and Monschau, in a charter dated. 15 February 1345, declares that hewill respect the prohibition toadmit more than thirty nuns into the convent of St. Gerlach: et ea de causa receperunt et habent inhibitionem a suis superioribus sive praelatis ne aliquando de caetero recipiant domicellam in suum conventum donec ad tricesimum numerum redigantur (see Habets, 'Houthem-Sint-Gerlach', 216-217, no. 10). Consequently, for the text edition, copy C was preferred as the basic text, with an indication of the variants of B in the notes.

Abbess Guda (of Rennenberg) and the convent of Thorn abbey and Willem II, lord of Horn and guardian of the abbey, appoint Gijsbert of Bruchausen, Jan of Rennenberg, canons of Liege, Hendrik of Baexem, knight, and Marsilius of Berg as arbitrators to settle their disputes.

Consequently, the scriptor of these charters can be located in the abbey of Thorn.

Willem van Born, priest of Geertruidenberg, issued two charters renouncing his claims regarding a dispute with the abbey of Thorn. The present charter concerns his relationship with the chapter of St. Lambert at Liege, the second with the bishop of Liege and the archdeacon dated 1283 (shortly before 16 March) (see Thorn Collection, no. 49). Both charters show strong dictation affinity but were not written by the same hand. The present charter is, however, the pre-correspondence of Collection Thorn, no. 49.

Although this charter has not been copied in the cartulary of the abbey of Thorn (Maastricht, HCL, access no. 01.187B, archive Fiefdom of Thorn, inv. no. 1628), this manuscript does contain a reference to this document under the copy of the charter concerning the relations with the bishop and the archdeacon (Collection Thorn, no. 49): Similis adhuc littera habetur quo isteWilhelmus, investitus de Monte SancteGertrudis, obligavit se capitulo Leodiensi contra predictam compositionem non venire debere.

Abbess Guda of Rennenberg and the convent of the abbey of Thorn establish a beguinage at Thorn for twelve beguines and for that purpose designate abbey property, rents and revenues at Eisden, coming from the property of Mabilia, widow of Hendrik, guardian of Eisden and her children, with which they bequeath to the beguine Ida, widow of Hendrik Pauwens. They also draw up provisions regarding the use of these goods and revenues and lay down the obligations of the beguines.
